Prop 49 was on the ballot in 2014 but was ruled ineligible after a right-wing legal campaign.
However, the California Supreme Court recently ruled 6-1 in favor of the measure's legality, clearing the path for the nation's most populous state to send a message to Congress to overturn one of the most controversial and consequential US Supreme Court decisions in history.
